1) Agreement to these Terms

By accessing behighlevel.net (“Website”) or purchasing our services, you agree to these Terms of Service (“Terms”). If you do not agree, please do not use our Website or services.

2) Our Services

We provide creative and digital services, including (but not limited to):

  • Graphic Design
  • Social Media
  • Advertising Campaigns
  • Mobile Games
  • Building Websites
  • Email Marketing
  • Video Editing
  • Photo Editing

Specific deliverables, timelines, pricing, and scope will be described in your order, invoice, proposal, or written agreement (“Project Agreement”).

3) Quotes, Orders, and Scope

  • Quotes: Quotes are estimates and may change if project requirements change.
  • Scope: Work is performed based on the agreed scope. Requests outside scope may require a new quote.
  • Client responsibilities: You agree to provide timely feedback, content, assets, and approvals required to complete the project.

4) Turnaround Times & Revisions

  • Estimated turnaround times are provided in the Project Agreement.
  • Revision rounds (if included) will be stated in the Project Agreement. Additional revisions may be billed.
  • Delays caused by missing assets, late feedback, or third-party issues may extend timelines.

5) Payments

  • Payment processor: Payments may be processed through Stripe.
  • Fees & taxes: Prices may be exclusive of taxes unless stated otherwise.
  • Late payments: If applicable, work may be paused until payment is received.

6) Refunds, Cancellations, and Chargebacks

Refund eligibility depends on the type of service and project stage. Our Refund/Cancellation Policy (if provided on the Website or in the Project Agreement) applies.

  • Work started: Once work has started, refunds may be partial or unavailable depending on progress.
  • Completed delivery: Delivered/approved work is generally non-refundable.
  • Chargebacks: If you initiate a chargeback without contacting us first, we may pause support and provide evidence to the payment processor.

7) Intellectual Property (IP) & Licensing

  • Your content: You retain ownership of materials you provide (logos, photos, text, etc.). You grant us a license to use them to perform the services.
  • Our work product: Unless stated otherwise, final deliverables become yours after full payment is received.
  • Working files: Source files (PSD/AI, project files, raw edits) are provided only if included in the Project Agreement.
  • Portfolio use: Unless you request in writing otherwise, you allow us to display completed work for portfolio/marketing purposes (without sharing private info).

8) Third-Party Tools & Platforms

We may use third-party tools (e.g., hosting, plugins, ad platforms, email platforms). We are not responsible for third-party outages, policy changes, or account actions taken by third parties.

9) Website Use Rules

  • Do not misuse the Website or attempt to disrupt its operation.
  • Do not copy, resell, or exploit Website content without permission.
  • Do not submit unlawful, harmful, or infringing content.

10) Disclaimers

  • Our services are provided “as is” and “as available,” to the maximum extent permitted by law.
  • We do not guarantee specific results (e.g., ad performance, rankings, revenue) unless explicitly agreed in writing.

11) Limitation of Liability

To the maximum extent permitted by law, BE HIGH LEVEL will not be liable for indirect, incidental, special, or consequential damages (including lost profits, lost data, or business interruption). Our total liability for any claim related to the services will not exceed the amount you paid for the specific service giving rise to the claim.

12) Indemnity

You agree to indemnify and hold BE HIGH LEVEL harmless from claims, damages, liabilities, and expenses arising from your content, your misuse of our services, or your violation of these Terms.

13) Termination

We may suspend or terminate services if you breach these Terms, fail to pay, or engage in abusive or fraudulent activity. You may also request termination, subject to any applicable Refund/Cancellation terms.

14) Governing Law

These Terms are governed by the laws applicable in the United Kingdom, unless otherwise required by mandatory local law.

15) Changes to these Terms

We may update these Terms from time to time. The updated version will be posted on this page with a new “Last updated” date.
